All family members of Italian citizens have a right to reside in Italy, no matter what their nationality.

Family members – spouse or partner, children up to 21 years old and the partner’s children, grandchildren, parents, grandparents… – have a right to a residence permit. After five years, they have a right to permanent residence.

Which family members are entitled to a Residence Card?

  1. Spouses and partners
  2. Children of the couple (until 21 years of age)
  3. Children of the Italian citizen or of the non-Italian spouse or partner (until 21 years of age)
  4. Children above 21 years of age, if maintained by the Italian citizen
  5. Parents, if maintained by the Italian citizen
  6. Grandchildren and grandparents of the Italian citizen
  7. The parent’s of the Italian citizen’s spouse (or same-sex registered partner)

Example:

The parents of a Chinese daughter who resides in Italy and is married (or registered in a same-sex partnership) with an Italian citizen have a right to enter (visa-free) and stay in Italy under option #6. If their daughter has children in Italy, the right of said parents to enter and stay in Italy falls additionally under option #5.

How does it work?

Just move to Italy with your Italian family member.

In some cases, you may need a visa to move to Italy. That depends on your nationality. Find out here how to obtain a visa.

Once in Italy, you will register with the immigration authorities (Questura). I have a tip for you: sometimes the Italian authority grants a temporary “Family Residence Permit” to the family members of Italian citizens.

That is a 2-years residence permit called Permesso di Soggiorno per Motivi Familiari.

This permit is enough for family members to access health care coverage, work, study, and travel visa-free to the other 27 European Union member states.

However, this type of permit has some distinct disadvantages. It doesn’t allow you to:

… stay in any other European Union member state after three months;

… work or study in any other European Union member state, even on a temporary basis;

… enjoy any social/healthcare benefit in any other European Union member state;

… avoid a time-consuming renewal process: every second yearyou must undergo a full review of requirements and documents which takes months.

Is there an alternative?

Yes. My advice is to opt for a RESIDENCE CARD.

In fact, family members to Italian citizens (or to any other European Union citizen) have a right to a long-term residence card. Besides, after 5 years of residence in Italy, you are entitled to a permanent card. In Italian, it is officially called “Permesso di soggiorno per familiari di cittadino comunitario”.

A Residence Card is a special treat for the family members because the family is so important in Italy.

As a family member of an Italian citizen, you are eligible for the 5-years residence card and have free access to work, business, studies, health care, and most rights on a par with Italian citizens.

Italian authorities tend to give a 1 or 2-year “Family Residence Permit” if you don’t insist on a 5-year Residence card. That might have to do with the fact that a Residence Card sets you free from bureacratic renewal procedures for a long time and enjoys benefits for at least five years. But the law is on your part. So it’s up to you to claim your rights and demand a Residence Card.

Residence cards for Italian citizens’ family members are free of charge.

How can you obtain a Residence Card?

You just hand to the local immigration office the following:

A copy of your passport (show the original)
An official certificate proving that you are a family member (e.g. a marriage certificate)
Copy of your Italian family member’s id card
Documents of your income, showing that your family have a sufficient income and do not have to depend on the public security (you don’t ned to have a job for that)

Remember: Residence cards are for families residing in Italy. In order to obtain it, both you and your Italian citizen family member need to move to and reside in Italy.

Alternatively, you can have a similar residence card if you move with your Italian family member to another country within the European Union.

For parents:

In case the applicant is the parent of an Italian citizen or of the Italian citizen’s spouse (or same-sex registered partner) as per categories #4 and #6 above, additional documents are required to prove that the applicant is partly or totally maintained by the concerned child (i.e. the Italian citizen or of the Italian citizen’s spouse or same-sex registered partner). This requirement is called “Vivenza a carico”.

Viable documents to this end are bank statements showing that the concerned child sent money to the parent, tax reports, and statements by accountants, as well as any other official statement from Italy or from the authorities of the applicant’s country of origin/residence. Such documents should be translated into Italian and legalized by the Italian Consulate.

Alternatively, the parent may first apply for a residence permit for family reasons and the child should add the parent to the Italian tax report for that year. The following year, the Italian tax report will be accepted as a sufficient document to obtain a 5-year residence card.

In some circumstances, the parents of minors with Italian citizenship can be granted a residence permit, even if they do not live together. In that case, it is important to show the authorities both proof of family tie (the child’s birth record showing parentship) and of the parent’s right of shared custody or visit.

    I am Married to an Italian citizen and we live now together in Egypt.
    I want to move to Germany to study while he is still in Egypt and he willnot come with me.
    How can i manage a situation like that?
    Is that possible to get residence in Germany and study without his existence in Germany?

    1. No. Your right of residence as a family member of an EU national depends on the actual presence of your husband. The law requires that you reside together in the considered EU member state.

      1. That depends on the number of family members. For a family of two parents and three children, the 2021 minimum income requirement is € 17.950,92. For future reference, you can google the string assegno sociale annuo 2021 permesso familiari Good luck!

    Fist fo all, thank you very much for these useful information. I recently moved to Milan with my husband (Due to his job) and planning to apply for carta di soggiorno but I’m not sure if document that we have is sufficient enough to support the KIT.

    My condition;
    I’m Thai, My husband is Italian.
    We lived in Amsterdam for 4 years and I’m holding NL residence permit card (Family member of EU citizens).
    We married in Amsterdam since 2017 and recently registered our marriage in Italy.

    Document on hands;
    1) My passport
    2) My husband ID
    3) My NL residence permit
    4) Letters showing that my husband and I have registered to address in Milan.
    5) Marriage registration certificate from NL, available in ENG
    6) My husband Employment contract starting on 12 June 2019 ( we can provide income statement, if needed)

    Could you please kindly suggest if what we have is sufficient or do we need other evidence?

    1. The list of documents can vary from city to city. The police retain the right to request more documents after receiving the application. I expect that they will require more documents concerning your income as a family.

I am an non-EU citizen with French student residence card, and I am studying in France currently. My boyfriend is an Italian citizen who works in Italy now, and I will move to Italy next month to live in the future. I can enter Italy with my French residence card, but I can only use it in Italy for no more than 3 months I think. So I would like to know what kind of residence permit I should apply in Italy which can allow me to stay in Italy for long-term and be able to work there?     1. The answer depends on your nationality (passport). If you are a non-EU citizen, you cannot stay longer than three months. You should return to your country of origin or residence and apply for a study or work visa. An alternative is to apply for a residence permit as the unmarried partner of an Italian citizen. Article 7 section 2 of Decreto legislativo no. 30/2007) states that the local authority (Questura) shall, in accordance with its national legislation, facilitate entry and residence of any other family members, irrespective of their nationality in the country from which they have come are dependants or members of the household, including the partner with whom the Italian citizen has a durable relationship, duly attested. However, the Questura has no obligation to grant such a permit under Italian law. But it is worth trying and insisting (possibly with the help of a legal operator). Several Questure issued such permits, especially to the partners of Italian citizens.

    My name is fred am from Nigeria I came to Italy in 2015 as asylum seeker in 2016 I left to Austria without finishing my asylum process in that same 2016 I ment a girl we fell in love and we get married in Austria so in 2017 I came back to Italy I started my asylum process again and my asylum was denied I appeal it true court the judge granted me 6 months sorjorno to stay in Italy while the process is still on in December last year(2018) the judge refused my asylum case and I could not renew my 6 months sorjorno,last year December my Austrian wife(EU citizen)give birth to my child a boy on the 1.12.2018 then in February this year(2019) my wife and my son move to join me here in Italy,we are now staying together as one big family here in Italy,my question is:now my wife is staying with me in Italy with my child and my wife and son are EU citizen can I apply for the EU resident permit for family member here in Italy?and what are the document requirements? And is my Austrian marriage certificate valid here in Italy?please I need help and will be waiting for your reply thanks,

    1. Yes. It’s just a question of income. If you can prove an income barely above the threshold for family reunification (ricongiungimento familiare), you may obtain only a residence permit for family reasons (for 2 years, renewable). If you can prove to have a higher yearly income (there is no threshold by law), you can obtain a 5 years residence card. It is worth insisting since many Questure tend to give the former more easily and the latter only after discussions (and possibly a legal operator helping you).

    1. Provided that you have custody of the Italian child (fully or partly) or a right to visit, you can apply for a residence permit for family reasons (coesione familiare) according to article 30, section 1 d of Decreto legislativo 286/1998. You will be required to show that you can support you and your child and have suitable accommodation for both.
